Divorce mediation is a divorce process that takes place outside of court, under the direction of a mediator. A mediator is a neutral third party (usually an attorney; sometimes a therapist) who facilitates discussion to resolve the issues of your divorce, such as custody and visitation, support, and division of property. A mediator is trained in negotiation and can give you and your spouse some information and guidance about the law, but does not represent either spouse individually and cannot give individual legal advice. For divorce mediation to be successful, both spouses must be willing to negotiate in good faith with a fair settlement as the goal. A balance of power between you and your spouse–where you both have knowledge of and are part of making financial decisions–is equally important.
